Terms and Conditions

The services of StyleSwipe are provided by TITANIUM Kft. (company name: TITANIUM Szolgáltató és Kereskedelmi Korlátolt Felelősségű Társaság; registered office: 6724 Szeged, Kálvária sgt 22.; company registration number: 06 09 000182; tax number: 10333167-2-06; hereinafter referred to as “StyleSwipe”).

These Terms and Conditions (the “Terms”) set out the terms and conditions for access to and use of StyleSwipe’s websites, mobile applications and other platforms.

StyleSwipe is a platform that connects fashion product sellers registered as partners (“Partner”) and users registered on the App (“User”) and facilitates related transactions, allowing Users to discover and purchase fashion products in one place (“Service”)

The Terms cover all web pages, blogs, features and content (including all information, text, graphics, photographs, product listings, links or other materials compiled by the User that are available on or linked to the Service, and applications offered by StyleSwipe (collectively, “Content”)) operated by StyleSwipe. By using the Service, you agree to be bound by and comply with these Terms. In addition, if you purchase a product through StyleSwipe, you may also be subject to the terms, conditions, policies and guidelines of a StyleSwipe Affiliate. The latter can be accessed via the Affiliate website.

  1. Basic provisions

You are entitled to use the Service after the age of 14, provided that you are not excluded from using the Service under the laws of Hungary or any other country. Please note that some Affiliates’ terms and conditions of use and purchase may require a higher age to use the Affiliate Services and purchase products. You may use the Service only in compliance with these Terms and applicable national and international laws.

The Service offered by StyleSwipe is constantly evolving and its nature and form may change from time to time without notice. StyleSwipe reserves the right, in its sole discretion, to impose limits on the Service at any time. It may do so without liability of any kind. In addition, StyleSwipe may suspend the availability of the Service (or any of its features), temporarily or permanently, at any time, without notice.

The Service may also contain advertisements that may be directed to Content, information, searches on the Service or other data available on the Service. The types and extent of advertisements displayed by StyleSwipe may change from time to time. Because StyleSwipe provides you with access to the Service, you agree that StyleSwipe and its third party service providers and Partners may place advertisements on the Service.

Hungarian law shall govern the matters not regulated in these Rules and the interpretation of these Rules, in particular with regard to the relevant provisions of Act V of 2013 on the Civil Code (“Civil Code”) and Act CVIII of 2001 on certain issues of electronic commerce services and information society services. The binding provisions of the relevant legislation shall apply to the parties without any specific stipulation.

  1. Account registration

You must accept these Terms in order to register on https://style-swipe.com/ or in the app that accompanies the Service (and thus create your own account, hereinafter “My Account”). During the registration process, you will be required to provide your username, email address and a password, and you will also have the option to set your user preferences, and you will be required to declare that you are over the age of 14. The registration constitutes a contract between you and StyleSwipe for the use of the Services, which is not a written contract, StyleSwipe does not keep a record of these contracts, but you can retrieve the Terms you accepted at the time of registration by date.

All personal data provided during registration is collected and processed in accordance with our Privacy Policy (hereinafter “Privacy Policy”) and our Cookie Policy (hereinafter “Cookie Policy”). It is your responsibility to ensure that the information you provide is true and accurate and that it is updated as appropriate in the event of changes. If StyleSwipe becomes aware that the information you have provided does not (also) include elements that are not true, StyleSwipe has the right to restrict your access to your My Account or exclude you from using StyleSwipe.

You are solely responsible for maintaining the confidentiality of the personal information (including username and password) you provide during registration and other personal information.

You agree to use your My Account registered with StyleSwipe for your personal use only and not to authorize others to use the account.

You must notify StyleSwipe immediately if you become aware of actual or suspected unauthorized third party access to your account. You are required to cooperate with StyleSwipe and assist in any action or proceeding we take to prevent or address unauthorized access, use or misuse of your account.

You can also register for StyleSwipe via Facebook Connect / Apple ID / Google Sign-In. By choosing this option, you consent to us accessing basic information related to your Facebook / Apple / Google account. This information is collected by Facebook / Apple / Google and shared with us in accordance with their privacy policy. We have no control over the privacy settings of your Facebook / Apple / Google account or how Facebook / Apple / Google treats your personal data. These matters are between you and Facebook / Apple / Google. Before using these features, we recommend that you carefully read the Facebook / Apple / Google policies and guidelines so that you are aware of how your data is handled. StyleSwipe is not responsible for any acts or omissions in connection with the use of features provided by Facebook / Apple / Google, and other related social media providers.

  1. Purchase products through StyleSwipe

If you are interested in a product displayed on the Service, StyleSwipe will redirect you to the Partner’s website via a link to that product. Accordingly, the purchase of a product recommended by StyleSwipe is made through the Partner’s website, the contract is between the Partner and the User and StyleSwipe does not become part of the contract. The payment transaction takes place on the Partner’s website and StyleSwipe is not involved in the payment transaction.

In accordance with the foregoing, any rights and obligations (including, without limitation, claims for defective performance, exercise of the 14-day right of withdrawal, claims for damages) in connection with the purchase of a product shall be owed to or incumbent upon the Partner. StyleSwipe accepts no responsibility for the quality of the product provided by the Partner, the correctness of the size, the speed of delivery or any claims arising from the purchase.

You acknowledge that it is your responsibility to choose the sizes on the Partner Websites and StyleSwipe cannot assist you in this. We will only provide you with a selection of clothes. If you purchase a product that does not fit your size or is more expensive than expected, it is your responsibility, as you will be provided with accurate information on both prices and sizes on the Partner brands’ websites.

We cannot be held responsible for recommendations that do not match your style, as the products we recommend are based on your feedback.

Please note that StyleSwipe does not have its own stock and products are delivered directly to you by our Partners. As such, your order will be subject to the Partners’ shipping, returns and refund policies. For any questions regarding shipping, refunds, exchanges or returns of products purchased, you should contact the Partner directly from whom you purchased the product.

  1. Accessing the Service

Access to the Service is permitted on a temporary basis and we reserve the right to withdraw, restrict, modify or terminate the Service without prior notice. We will not be liable if for any reason the Service is unavailable at any time or for any period (including, but not limited to, planned or unplanned outages, or any network (this includes mobile networks) outages, or if you are in an area not supported by mobile network coverage).

StyleSwipe makes no warranty and disclaims all responsibility and liability for the completeness, accuracy, availability, functionality, compatibility, freedom from defects, security, performance and reliability of the Service or any Content. StyleSwipe shall not be responsible or liable for any damage to your computer system, loss of data or other harm resulting from your access to or use of the Service.

You agree that StyleSwipe shall have no responsibility or liability for the deletion, failure to store or transmission of any Content or other communications stored or transmitted by the Service.

StyleSwipe provides the Service on an “as is” basis and you access and use the Service and any Content at your own risk. StyleSwipe makes no representations or warranties that the Service will meet your requirements or that the Service will be uninterrupted, secure or error-free.

We make no warranty or representation that the Service is free of viruses or anything else that may be infectious or destructive. You use the Service at your own discretion and risk, and you are solely responsible for any damage to your computer or mobile device that results from your use of the Service.

  1. Your rights

StyleSwipe grants you a personal, global, royalty-free, revocable, non-sublicensable, non-transferable and non-exclusive right to use the Service (which includes future updates that you may receive from time to time, provided that you agree that such updates may be subject to additional terms and conditions, which will be communicated to you when the update becomes available), subject to these Terms. This right is solely for the purpose of enabling you to use and enjoy the Service as permitted by these Terms.

Except as permitted by applicable law, you may not copy, reproduce, republish, reverse engineer, adapt, edit, distribute, lend, rent, sublicense, lease, create derivative works from, create derivative works of, or create derivative works based on any element of the Service, including, without limitation, its look and feel, code and software.

  1. StyleSwipe rights

All rights (including copyrights, trademarks and other intellectual property rights) and interests in the Service and the Content, including but not limited to all information, data, text, maps, graphics, “look and feel”, logos, icons, images, video clips, sound recordings, editorial content, notices, data compilations, page layouts, selection of content for the Service, and the underlying code and software for the Service remain the exclusive property of StyleSwipe and its licensors. The Service is protected worldwide by copyright, trademark and other laws and international conventions.

Any feedback, comments or suggestions that you provide in connection with StyleSwipe or the Service are entirely voluntary and StyleSwipe is free to use such feedback, comments or suggestions as it sees fit and without any obligation to you. However, we do not accept or consider creative ideas, suggestions, inventions or other materials (“Creative Ideas”) unless they are specifically requested. If you nonetheless submit a Creative Idea to StyleSwipe, StyleSwipe (i) is the exclusive owner of all rights now known or hereafter created in the Creative Idea; (ii) is under no obligation of confidentiality or liability whatsoever with respect to the use or disclosure of the Creative Idea; and (iii) is entitled to use the Creative Idea for any commercial or other purpose without restriction and without compensation.

You may not copy the Service or the Content, or any part of it, for the purpose of creating a collection, compilation, library or database of any kind unless you have our prior express written consent. If you copy or download any part of the Service or Content in breach of the Terms, your right to use the Service will cease immediately and you must, at our option, return or destroy any material you have created and any copies thereof.

  1. Restrictions on the use of the Content and the Service

You may not use the Service and/or any Content:

  1. in a manner that violates local, national or other laws or regulations, or any order or decision of any competent authority or court;
  2. for any purpose not permitted by these Terms;
  3. in a manner that infringes the rights of any person or entity, including copyrights, trademarks or other intellectual property rights, or other personal or contractual rights;
  4. distribute any advertisement or publish or otherwise communicate any false or misleading material or message;
  5. in a manner that intentionally or unintentionally harasses, annoys, threatens or intimidates any other User;
  6. publish a photograph of another person without their permission (if they are a minor, without the permission of their legal guardian);
  7. breach any security measures relating to the Service, or to investigate or test the vulnerability of any system or network, or to breach or circumvent any security or authentication measures;
  8. in a manner that intentionally or unintentionally deceives or misleads any other User;
  9. introduce any malicious software, virus or other harmful software program that intentionally or unintentionally damages or interferes with the operation of the Service, including, but not limited to, time bombs, Trojan horses, viruses or any other malicious software or hardware;
  10. copy, modify or distribute the content of other Users without their consent;
  11. for commercial purposes, unless expressly permitted by these Terms;
  12. circumvent measures used to prevent or restrict access to the Service;
  13. unauthorised access to the Service, the server on which the Service is hosted or any server, computer or database;
  14. in any manner that violates applicable Hungarian or international trade sanctions laws.

While we do our best to protect the security of your account, we cannot guarantee that unauthorised third parties will not be able to defeat our security measures. Please notify us immediately if your account security is compromised or unauthorized use is detected.

  1. Limitation of liability

To the fullest extent permitted by applicable law, StyleSwipe and its subsidiaries, affiliates, officers, employees, agents, partners and licensors shall have no liability of any kind:

  1. loss of profit, revenue or orders;
  2. for loss of income or revenue;
  3. loss of business opportunity, reputation or goodwill;
  4. for loss or damage to data or information;
  5. for the loss of expected savings;
  6. for any indirect, incidental, special, consequential or punitive damages,

arising out of or in any way connected with:

  1. to access or use the Service;
  2. delay in using the Service or inability to access or use the Service;
  3. to fulfill your orders from Partners, including but not limited to the delivery, exchange, return or refund of products purchased from Partners (in which case you are not contracting with StyleSwipe for the product in question, as set out above);
  4. any third party conduct on the Service, including without limitation any defamatory, offensive or illegal conduct by other Users or third parties;
  5. use any content, information, products or Services obtained through the Service; or
  6. unauthorised access, use or modification of your data or uploaded content,

whether based on contract or tort.

Your claim for damages against StyleSwipe is excluded to the maximum extent permitted by applicable law, excluding cases where your life, limb or health has been damaged. Exceptions are also made for damages that StyleSwipe has intentionally caused to you.

  1. Your responsibility

You are responsible for all content that you share on the Service or link to the Service. You agree that you will not hold us liable for anything that other Users say or do through the Service. If you have a dispute with another User, you release us (and our officers, directors, agents, affiliates, joint ventures and employees) from all claims, demands and damages, known or unknown, arising out of or in any way connected with such dispute.

You shall indemnify us and hold us harmless from and against all liabilities, costs, expenses, damages and losses, including legal fees and all other reasonable professional expenses, which we incur or which we suffer or incur in the use of the Service and Content as a result of your breach of these Terms or any applicable law.

  1. Data protection

Your data will be processed in accordance with the StyleSwipe Privacy Policy.

As Affiliates are not part of the StyleSwipe app, they are solely responsible as independent data controllers for the use of your personal data, delivery details and payment details once we have shared your data with them, so you should carefully review their privacy policy before making a transaction.

  1. Unsubscribe from

We reserve the unconditional right to suspend, revoke, terminate, modify or restrict access to any part or all of the Service at any time, immediately, without notice, for any reason (including without limitation in the following circumstances), if:

  1. there is reasonable suspicion that you are using the Service in an unauthorised or fraudulent manner;
  2. we have reasonable grounds to suspect that you have not complied with these Terms; or
  3. we have a reasonable suspicion that you or a third party has breached confidentiality obligations or infringed our intellectual property rights.

To the fullest extent permitted by law, we expressly exclude all relevant terms and conditions that may apply to us in relation to any liability you may have to us in connection with such suspension, revocation or amendment.

Upon termination of access to the Service, all rights granted to you in connection with the Service will immediately cease.

  1. Disputes, applicable law

The Hungarian courts shall have exclusive jurisdiction to settle any claim relating to or arising out of the use of the Service. These Terms and any disputes or claims (including non-contractual disputes or claims) relating to or arising out of these Terms shall be governed by Hungarian law.

In accordance with the provisions of Act CLV of 1997 on Consumer Protection, if any consumer dispute between you and StyleSwipe is not resolved through negotiations, you may refer the dispute to the conciliation body competent for your place of residence or domicile and initiate the proceedings of the body, or you may refer the dispute to the conciliation body competent for the place where StyleSwipe is established.

Unless you request a personal hearing, the conciliation panel will hold the hearing online, without your personal presence, by means of an electronic device that provides simultaneous audio and video transmission.

  1. Final provisions

You acknowledge that you have not based your acceptance of these Terms on any representations, warranties or covenants not expressly made in these Terms.

If any provision is found by the appropriate authority to be invalid, this shall not invalidate the whole of these Terms and in that case the provision shall be modified and interpreted so as to achieve the purpose of the invalid provision to the maximum extent possible within the limits of applicable law or court decision.

If a dispute arises between us, we strongly recommend that you first contact us directly at the address provided or by email at‎4 . above to try to find a solution. We recommend the use of alternative dispute resolution procedures (such as mediation or arbitration) instead of litigation

Failure to exercise any of our rights or remedies does not constitute a waiver of those rights or remedies. Although we may transfer any of our rights or obligations to a third party, if we do so, we will ensure that your rights or obligations will continue to be respected by the receiving party.

Nothing in these Terms shall constitute a partnership between the parties, and neither party shall be deemed to be an agent or employee of the other for any purpose.

StyleSwipe may change these Terms from time to time and the latest version will always be available on the website and in the app. If, in StyleSwipe’s sole discretion, the changes are found to be material, StyleSwipe will send you a notification by email to the email address associated with your account. If you continue to access the Service after the effective date of the changes, you agree to be bound by the amended Terms.

These Terms are drafted in Hungarian. If there is any discrepancy between the Hungarian version of the Terms and any translation, the Hungarian version shall prevail.
