It is important for us to provide you with transparent and understandable information about how we handle your personal data when you use StyleSwipe services. In this document, we explain in detail what data we collect in connection with StyleSwipe services, how we use it and what your rights are in relation to data processing.

Who will be the data controller?

What data is personal data and what does it mean?

Any data or information which, alone or in combination with other data or information, makes it possible to identify, directly or indirectly, a specific person shall be considered personal data.

Personal data can include, for example, name, address, place and date of birth, mother’s name, identity document number - this is known as personal identification data. However, any other data which, together with any of the above, is capable of identifying you, if known, is also personal data.

Some personal data are entitled to special protection, such as health data. StyleSwipe does not process special personal data.

Any operation which is performed on personal data, such as the collection, storage, use, organisation, transmission, modification, combination with other data, erasure or destruction of data, is considered processing.

How do we protect your personal data?

StyleSwipe does its best to keep your data safe. This means we ensure that your data is confidential, accurate and accessible.

  • Confidentiality: only those who are authorised to do so have access to your data.

  • Accuracy: your data will always be accurate and relevant to the purpose for which it is processed.

  • Accessibility: authorised persons can access the data whenever they need it.

StyleSwipe has implemented various technical and organisational measures to protect your data from loss, manipulation or unauthorised access. These measures are regularly checked and updated to keep them up to date. If there is a problem with the protection of your data that could pose a serious risk to your rights, we will notify you within 72 hours.

StyleSwipe and its data processors use various security measures (e.g. firewalls) to ensure that your data cannot be accessed, disclosed, transmitted, modified or deleted by unauthorised persons. StyleSwipe continuously monitors, maintains and updates the systems and software we use to manage your data.

IMPORTANT! Please ensure that you are responsible for the security and confidentiality of any user data and passwords that you provide or disclose.

What data do we collect and process?

Personal data will always be processed in accordance with the applicable data protection legislation. When you contact us, for example by registering, sending us an email or filling in a form on our website, you agree that we may use the information you provide for the purposes described in section VII of this Privacy Notice.

When you visit our websites, cookies (cookies) automatically collect personal data. You can read more about this in section VIII of this notice.

How long do we process and store personal data?

StyleSwipe will process personal data only for as long as the purpose of the processing exists or as required by law. Once the purpose of the processing is fulfilled or the legal obligation ceases, or if you request it, your data will be deleted or anonymised. StyleSwipe reserves the right to cease processing at any time, except for data necessary for the provision of the service, and to delete data when it is no longer necessary to process it.

To which third parties can we transfer personal data?

  1. Transmission to public authorities

StyleSwipe may be obliged to disclose certain data to the competent authorities (such as the police) in the event of a legal obligation or a request from a public authority. In the event of a data breach, i.e. accidental or unlawful destruction, loss, alteration, unauthorised disclosure to a third party or unauthorised access to data we have under our control, we may be required to transfer certain data to the data protection authority.

  1. Transfer to data processors

In processing personal data, StyleSwipe uses professional partners, so-called data processors, who act on behalf of StyleSwipe. The data processor is obliged to carry out its activities in accordance with the mandate and the applicable legal requirements. StyleSwipe is liable to the data subject for any damage caused by the data processor.

We have carefully selected our data processing partners, who take appropriate technical and organisational measures to ensure that your data is processed in accordance with data protection regulations and that your rights are protected. The partners must not use the personal data provided for their own business purposes and must not transfer the data to third parties.

For example, we may use data processors to carry out marketing activities (e.g. call centre, marketing agency, sending newsletters) or to provide user analytics (e.g. tracking and analysing user activity and interactions).

Personal data will be processed only in accordance with the rules of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) and Act CXII of 2011 on the Right to Information Self-Determination and Freedom of Information (Infotv.),

i. in connection with the preparation and performance of a contract you intend to enter into with us (for example, when you request a quote or use our services by accepting our Terms and Conditions);

ii. where StyleSwipe has a legitimate interest in doing so (for example, a contractual or non-contractual claim, customer satisfaction measurement); or

iii. if you have given your explicit consent to the processing of your data for one or more specified purposes and in one or more specified ways.

In addition to the above, StyleSwipe may also be required by law to process certain data or to retain it for a certain period of time.

  1. Data processing related to the preparation and performance of the contract

Reply to a contact

If you request any form of offer or information about any StyleSwipe service (by phone, email, online form or in person), we will process the information you provide.

The purpose of the processing is to respond to your request or request. Duration of data retention: unless you have consented to other types of processing based on your consent, we will retain your data for the period necessary to process your request or other enquiry, but for no longer than 12 months.

Registration, login

You can register for StyleSwipe services with an email address and Facebook, Apple and Google accounts. When we process your registration data, we process your email address and the data associated with the identification of your Facebook, Google or Apple account in order to create (log you into) your StyleSwipe account and make the StyleSwipe service available to you.

The data will be retained for the duration of the user account. If you delete your account, the data will be deleted within 30 days at the latest.

Managing user preferences

After registration, you will be asked which gender-associated wardrobes you would like to view. Your answer will be recorded - linked to your account - so that we can continue to show you content relevant to your choice (until you change your choice). Related to this, for example, if you swipe right on a wardrobe, it will be saved to your associated favourites so that it can be retrieved and accessed for future shopping.

The data will be retained for the duration of the user account. If you delete your account, the data will be deleted within 30 days at the latest.

Developing a style profile

Based on the right or left pulls of each wardrobe or product, we are constantly developing a style profile that helps us to provide more accurate recommendations on the main page. The style profile includes style labels for wardrobes and garments (e.g. chic, monochrome, minimalist).

The data is retained for the duration of the user account. If you delete your account, the data will be deleted within 30 days at the latest.

Information on new product offers and promotions

Where you consent, we may process your email address (for the purpose of sending you newsletters) and/or your device ID (for the purpose of sending you push messages) for the purpose of sending you information about StyleSwipe’s own and/or its partners’ product offers and promotions.

Data retention period: until consent is withdrawn.

Developing our services

By analysing the personal data processed in the app and the information (logged, inferred) available to it through the use of the services, StyleSwipe continuously monitors user trends (for example, what wardrobes and clothing items users prefer) by generating anonymous statistics. In doing so, we process data about the device you are using (device type, operating system, app version number), data about your use of StyleSwipe (pages viewed, taps/clicks, time spent on a given interface), your IP address, and data about other user interactions (e.g. error messages, crashes, feature usage data). The data is anonymised.

We use analytics for service improvement purposes, including improving application performance and user experience, examining analytics trends and usage patterns, identifying and improving technical problems, and developing new features. We do not sell or share data for advertising purposes.

For this processing, we use the services of PostHog Inc. as data processor. The data processor may transfer the data to a third country (United States) within the framework of the EU-US Data Privacy Framework compliance decision approved by the European Commission.

Data retention period: until you withdraw your consent.

What are cookies and social plugins and what are they for?

StyleSwipe’s websites and applications automatically collect data through the use of cookies, which are small text files that store internet preferences. Almost all websites use this technology.

The first time you visit the website, the cookie is automatically downloaded from your search engine. The next time you access the website from the same device, the cookie - and the information it contains - is either sent back to the website that created it (known as a ‘private cookie’) or to another website to which it belongs (known as a ‘partner cookie’). This allows the website to recognise that the page has been accessed using this search engine and, in some cases, to modify the content it displays.

Who has the right to know your data that we process?

The data processed may be accessed by the relevant employees of StyleSwipe and by the employees of the data processors identified in this notice to the extent necessary for the performance of their tasks.

What are your rights regarding data management?

You are eligible at any time:

a.) Request information about the processing of your personal data,

b.) Request the correction of your personal data,

c.) Request the restriction of the processing of your personal data (withdraw your consent to certain processing or change the form of contact requested),

d.) Request the deletion of your personal data (withdraw your consent in full),

e.) Request the transfer of your personal data to another controller (data portability).

You can exercise your rights by sending a statement to the StyleSwipe contact person at [email protected] or by post to 6724 Szeged, Kálvária sgt 22.

You can request information from StyleSwipe about the processing of your personal data. StyleSwipe will respond in writing within 30 days. The information is free of charge if you have not already submitted an information request to StyleSwipe in the same area in the current year. Otherwise, the information will be provided against reimbursement of the costs incurred.

You can request StyleSwipe to correct the data we hold about you, indicating the correct data. StyleSwipe will make the correction in its records and notify you when it has been made.

You may withdraw your consent to the processing of all or part of the data you have already given at any time in writing, without limitation and without any obligation to pay a fee, without giving any reason. StyleSwipe shall, without undue delay after the notification of the withdrawal of consent, ensure the cessation of processing, permanently erase from its records the personal data affected by the withdrawal, notify the data processor and the persons involved in any data transfer of the erasure, and comply with its legal obligations of record-keeping. Exceptions to this rule are personal data that StyleSwipe may process for the purposes of complying with a legal obligation to which it is subject or for legitimate interests established by a balancing of interests, as described above, without further specific consent and even after consent has been withdrawn.

You may request StyleSwipe, in writing or otherwise, to transfer your data that we process to a third party data controller designated by you (data portability). StyleSwipe will transfer the data within 30 days of the request and will delete the transferred data from its records and notify you accordingly.

Deletion of your account

After account deletion, all personal data related to the user (such as e-mail address, registration data, user preferences, style profile) will be permanently deleted within a maximum of 30 days from the date of receipt of the request, except for data that we are legally obliged to keep.

Deleting an account is permanent; once deleted, it is not possible to restore the account and its associated data.

What should you do if you have a complaint?

You can lodge a complaint about the processing of your data at any time by sending an e-mail to [email protected]. We will investigate the complaint within 30 days of receipt, take action as necessary and notify you of the outcome of the investigation and any action taken.
